What a liability waiver is
A liability waiver — also called a release of liability or waiver of liability form — is an agreement in which a participant accepts the ordinary risks of an activity and agrees not to hold the organizer responsible if those risks lead to injury. Gyms, sports leagues, climbing and trampoline venues, tour operators, equipment-rental shops, and event organizers use them every day.
Both sides benefit from a cleanly completed waiver: the business gets a legible, signed record, and the participant knows exactly what they agreed to. A waiver signed digitally and stored as a PDF is much harder to lose than a paper stack behind a front desk.
What the form usually contains
- the participant's name and contact details;
- a description of the activity and its inherent risks;
- the release language — who is being released, and from what;
- an emergency contact, and often a medical-conditions line;

Courts generally will not enforce a waiver for gross negligence or intentional harm, and how far a waiver can go differs sharply from state to state — which is why businesses should have their template reviewed locally, and participants should actually read what they sign.
Liability waiver vs. lien waiver
Despite the shared word, a lien waiver is an entirely different document from the construction world: a contractor or supplier signs it to give up their right to place a lien on the property, usually in exchange for payment.
