What an affidavit is

An affidavit is a written statement of facts sworn to be true. The person making it — the affiant — signs under oath, which means knowingly lying in an affidavit carries the same legal weight as lying under oath in court. Because of that, affidavits are accepted as evidence in court cases, probate, banking, insurance claims, and many everyday disputes.

A typed affidavit reads far better than a handwritten one: the facts are legible, the numbered statements stay aligned, and nothing gets squeezed into a margin. That is exactly the kind of document AnyPDFfiller is built to fill.

Common types of affidavit

  • General affidavit — a flexible sworn statement about any facts, used when a bank, court, or agency asks you to "put it in writing under oath";
  • Small estate affidavit — a probate shortcut that lets heirs collect a modest estate without a full court process (each state sets its own dollar limit and waiting period);
  • Affidavit of residence — proof of where someone lives, often for school enrollment or a DMV (what it must include);
  • Affidavit of identity — confirming who you are, commonly for banks or title companies;
  • Financial-support declarations — in immigration cases these take specific USCIS forms; see Form I-134.

What goes into the form

  • a title and, for court filings, the case caption;
  • the affiant's full name, address, and sometimes date of birth;
  • the facts, usually as short numbered statements written in the first person;
  • an oath clause ("I swear/affirm the foregoing is true and correct");
  • the affiant's signature and date;
  • a notary block (jurat) where the notary certifies the oath was taken.

One important habit: sign where the notary tells you to. Most affidavits must be signed in the notary's presence — so fill everything else in advance, and leave the signature for the appointment if your notary requires it.

How to fill an affidavit with AnyPDFfiller

Upload the affidavit PDF, click each line, and type the affiant details and the numbered facts. Keep each statement short — one fact per number. Add the date, and if your notary allows pre-signed documents, place your signature as well. Then download the completed PDF and print it for notarization. Everything you type stays in your session and is kept private.

Affidavit questions people ask

Does an affidavit have to be notarized?

Traditionally yes — the notary administers the oath and completes the jurat. Some courts and agencies instead accept an unsworn declaration signed under penalty of perjury, so check what the receiving party requires.

Can I type an affidavit instead of writing it by hand?

Yes, and it is usually preferred — typed statements are legible and unambiguous. Upload the blank affidavit here, type the facts, and print the finished document for the notary.

What is a small estate affidavit?

A sworn form heirs use to collect a deceased person's property without full probate when the estate is under the state's threshold. The dollar limit and waiting period differ by state, so use your state's version of the form.

What happens if something in an affidavit is false?

Swearing to false facts is perjury, a criminal offense. Only state facts you personally know to be true, and say "to the best of my knowledge" where that is genuinely the case.

Does filling the affidavit here cost anything?

Filling and downloading are free — upgrading removes the watermark from the download. Notary fees are separate and set by the notary.

AnyPDFfiller is a PDF-filling tool, not a law firm, and nothing here is legal advice. Affidavit requirements — notarization, small-estate limits, acceptable declarations — differ by state and by the court or agency receiving the document, so follow their instructions or consult an attorney for anything contested.
